Ijebu-Ode (Ogun) – An Ijebu-Ode Customary Court in Ogun on Wednesday dissolved a 10-year-old marriage between of one Alhaji Ibrahim Oduwole and his wife, Shade, on the ground of childlessness and provocation.
Oduwole had earlier in February taken his wife before the court seeking the dissolution of the 10-year-old marriage accusing her of childlessness, provocation and uncaring attitude towards him.
Oduwole, 70, told the court that Shade, 35, could not bear him children in the last 10 years of their marriage, adding that she was fond of fighting him on a regular basis.
“In spite of the fact that my wife could not bear me children since we got married 10 years ago, she is also fond of fighting me and does not care about my well-being.
“I want immediate dissolution of the marriage, and I also want the court to order her to return all my property back to me,” he said.
The wife, in her response, told the court that her childlessness was not her fault, adding that she had several miscarriages.
“My childlessness is not my fault. I try many times to conceive but, all resulted in miscarriages. “I don’t fight him as he claimed but rather he is the one that use to fight me,” she said.
She, however, agreed that, the marriage be dissolved.
In his ruling, the President of the court, Mr T.O. Kanimodo, said that considering the clear evidence given by the plaintiff, the court had no choice but to dissolve the marriage.
“Having considered the evidence presented by the plaintiff, the 10-year-old marriage is hereby dissolved with immediate effect.”
The court also ordered the respondent to park her belongings from the plaintiff’s house with immediate effect. (NAN)

This is ridiculous. Going by the age, the old man got married to her at the age of 25. Why will a 25 years old girl findcomfort in a 60 years old man, old enough to be her father? If the man had accused his wife of infidelity, i would have supported but telling the court that the wife does not respect him and fights him regularly call for the reveiw of our laws partaining divorce. In the part of the world that i live, the man will leave the house for the woman as she cannot stay outside and will be ask to make regular feeding allowances available to her monthly, but since we are in nigeria, were men are always kings, such old men can take advantage of our girls. Who is going to pay the woman for the 10 years wasted? What about the apple the old man sucked for 10 years, who is paying for that. Too many laws in our status book need to be reviewed to meet the present realities. Enjoying a woman for 10 years and deciding one day to send her pack without provisions for her is a law that needs urgenty attention by our never do well national assembly members. ReplyDeleteit is very easy in Nigeria, if it were outside Nigeria where the man will have to part with his wealth he will give it a rethink< by the way children comes from God, there are three basic ways to become part of a family 1. birth 2. adoption 3. marriage, i am driving at a point, if he could not bare children of his own through the woman he so claimed he loved before they got married what is wrong with adoption? we still have this myopic way of reasoning as Africans, the earlier we start to think of doing the right thing the right way the best for us all, adoption should be encouraged instead of break up, that is the evidence of true love, children is from God and not from man
